First Pro: Fire Fighter Edition Terms of Service

1. Acceptance of Terms

By accessing or using First Pro: Fire Fighter Edition (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of a fire department or other organization, you represent that you have the authority to bind that organization to these Terms.

Important: The Service is intended solely for professional firefighters and emergency responders aged 18 and older. Use of the Service constitutes acceptance of these Terms and our Privacy Policy.

2. Service Description

First Pro: Fire Fighter Edition is a training and professional development platform designed exclusively for fire departments and emergency services organizations. The Service includes:

  • Scenario-based micro-training modules
  • Incident documentation and debriefing tools
  • AI-generated training content from anonymized department experiences
  • Administrative tools for training management and compliance tracking
  • Mobile applications and web-based administrative portal

Critical Disclaimer: First Pro is a training and educational tool only. It is not intended for, and must never be used for, real-time emergency response, operational decision-making during active incidents, or as a substitute for official department protocols and procedures.

3. User Accounts and Department Subscriptions

3.1 Subscription Structure

  • Career/Full-Time Firefighters: $40 per firefighter per year
  • Part-Time/Volunteer/Paid-On-Call Firefighters: $20 per firefighter per year
  • Subscriptions are purchased by departments for their entire roster
  • Annual billing cycle only; no monthly payment options available

3.2 Account Management

  • Each firefighter receives individual access credentials
  • Departments control seat allocation and user management
  • When a firefighter leaves the department, the department may reallocate that seat to a new member
  • Users are responsible for maintaining the confidentiality of their login credentials

3.3 Payment Terms

  • Payment is due annually in advance
  • Failed payments receive a 4-week grace period before service suspension
  • Automatic renewal unless cancelled with 30 days written notice
  • Price changes only apply at contract renewal, not during existing contract terms

4. Acceptable Use Policy

4.1 Permitted Uses

  • Professional firefighting training and education
  • Incident documentation and after-action reviews
  • Department training management and compliance tracking
  • Professional development activities
  • Sharing experiences to improve fire service training

4.2 Prohibited Uses

You may not use the Service to:

  • Make operational decisions during active emergencies
  • Replace official department standard operating procedures
  • Record or share patient information, classified data, or sensitive personal information
  • Engage in harassment, discrimination, or inappropriate conduct
  • Attempt to reverse engineer, hack, or compromise the platform
  • Use the Service for non-firefighting commercial purposes
  • Share login credentials with unauthorized personnel
  • Submit false incident reports or training records

5. Intellectual Property and Content Ownership

5.1 First Pro Content

First Pro retains ownership of:

  • The platform software and technology
  • Training scenarios and modules (including those customized for specific departments)
  • AI-generated content and training materials
  • Proprietary algorithms and methodologies

5.2 User and Department Content

  • User-Generated Content: You retain ownership of content you create, but grant First Pro a license to use it for training purposes unless you choose to publish it independently
  • Department SOPs/SOGs: Departments retain ownership of their official policies and procedures uploaded to the platform
  • Incident Reports: Reports remain the property of the submitting department while granting First Pro rights to create anonymized training content

5.3 Protected Training Materials

All recordings, transcriptions, and AI-generated training materials are proprietary to First Pro and are NOT subject to Freedom of Information Act (FOIA) requests or public disclosure requirements.

6. Union-Friendly Provisions and Worker Protections

6.1 Collective Bargaining Compliance

  • Training data and performance metrics cannot be used for disciplinary action against firefighters
  • Individual performance data remains confidential and accessible only to designated department administrators
  • Departments may designate union representatives as privacy officers with appropriate access rights
  • The Service supports compliance with collective bargaining agreements regarding training and professional development

6.2 Data Protection for Workers

  • Individual training records are protected from misuse
  • Aggregated, non-identifying data may be provided to unions for collective bargaining purposes
  • Firefighters have the right to access their own training records
  • Union representatives may be present when individual firefighters access their records

6.3 Fair Labor Practices

  • Training completion during duty hours is subject to department policy and labor agreements
  • Off-duty training participation is voluntary unless required by department policy consistent with labor agreements
  • The Service supports equal access to training opportunities regardless of employment status (career, volunteer, part-time)

7. Limitation of Liability and Disclaimers

7.1 Training Tool Disclaimer

FIRST PRO IS A TRAINING AND EDUCATIONAL TOOL ONLY. IT IS NOT INTENDED FOR AND MUST NEVER BE USED FOR:

  • Real-time emergency response or operational decision-making
  • Replacement of official department standard operating procedures
  • Substitute for live training, certification programs, or hands-on instruction
  • Primary reference during actual emergency incidents

7.2 Maximum Liability Protection

TO THE FULLEST EXTENT PERMITTED BY LAW:

  • NO LIABILITY FOR OUTCOMES: First Pro, its employees, contractors, and affiliates are not liable for any injury, death, property damage, or other harm resulting from use of or reliance on the Service
  • USER RESPONSIBILITY: All decisions and actions taken by users are their sole responsibility, regardless of any content, training, or guidance provided by the Service
  • NO OPERATIONAL RELIANCE: Users acknowledge that they cannot and will not rely on the Service for operational guidance during emergencies
  • MAXIMUM DAMAGES: In no event shall First Pro's total liability exceed the amount paid by the department for the Service in the 12 months preceding any claim

7.3 Department Liability Acknowledgment

By purchasing the Service, departments acknowledge and agree that:

  • They are responsible for ensuring proper use of the Service by their personnel
  • They will not rely on the Service for operational emergency response
  • They understand the Service supplements but does not replace official training programs
  • They are liable for any misuse of the Service by their personnel

7.4 No Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

8. Service Availability and Support

8.1 Service Levels

  • We strive for high availability but do not guarantee uninterrupted service
  • Planned maintenance will be announced in advance when possible
  • Emergency maintenance may occur without notice
  • Service outages do not extend subscription terms or create refund obligations

8.2 Technical Requirements

  • Compatible mobile device with internet connectivity
  • Modern web browser for administrative functions
  • Sufficient storage for offline training content
  • Microphone access for incident recording features

9. Data Security and Privacy

9.1 Privacy Policy Integration

This Terms of Service incorporates our Privacy Policy by reference. Key privacy protections include:

  • Audio recordings deleted after 90 days
  • Training materials exempt from FOIA requests
  • Individual performance data protected within departments
  • Compliance with applicable data protection laws

9.2 Security Measures

  • End-to-end encryption for data transmission
  • Encryption at rest for stored data
  • Multi-factor authentication available
  • Regular security audits and updates
  • SOC 2 compliance implementation

10. Municipal and Government Compliance

10.1 Government Entity Requirements

  • Compliance with applicable prevailing wage laws
  • Equal opportunity and non-discrimination practices
  • Support for municipal procurement processes
  • Accommodation of city council or mayoral approval requirements

10.2 Audit Rights

Departments have the right to:

  • Audit First Pro's data handling practices for compliance verification
  • Request documentation of security measures and privacy protections
  • Review compliance with collective bargaining agreements
  • Receive reports demonstrating worker protection measures

11. Subscription Management and Termination

11.1 Department-Initiated Cancellation

  • Departments may cancel subscriptions with 30 days written notice
  • Upon cancellation, immediate loss of access to all Service features and uploaded content
  • Refund Policy:
    • 50% refund if cancelled within first 3 months from payment date
    • 25% refund if cancelled within first 6 months from payment date
    • No refund if cancelled after 6 months from payment date

11.2 First Pro-Initiated Termination

  • We may terminate service for violations of these Terms
  • No refunds provided for termination due to Terms violations
  • Departments forfeit access to all uploaded content upon termination for cause

11.3 Individual Firefighter Changes

  • Departing firefighters lose access immediately upon department notification
  • Departments may reallocate seats to new personnel
  • Individual training records remain with the department per our Privacy Policy

12. Updates and Modifications

12.1 Terms of Service Updates

  • We may update these Terms at any time
  • Updated Terms become effective immediately upon posting
  • Continued use of the Service constitutes acceptance of updated Terms
  • Material changes will be communicated through the platform

12.2 Service Modifications

  • We may modify, add, or remove Service features at any time
  • No guarantee of continued availability of specific features
  • Major changes will be announced to department administrators when feasible

13. Dispute Resolution

13.1 Governing Law

These Terms are governed by the laws of the State of Illinois, without regard to conflict of law principles.

13.2 Mandatory Arbitration

ALL DISPUTES MUST BE RESOLVED THROUGH BINDING ARBITRATION:

  • Administered by the American Arbitration Association
  • Conducted under AAA Commercial Arbitration Rules
  • Individual arbitration only - no class actions permitted
  • Arbitration location in Illinois unless mutually agreed otherwise
  • Each party bears their own costs and attorney fees

13.3 Exception for Injunctive Relief

Either party may seek injunctive relief in court for intellectual property violations or breach of confidentiality obligations.

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and First Pro regarding the Service.

14.2 Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions continue in full force and effect.

14.3 No Waiver

Failure to enforce any provision of these Terms does not constitute a waiver of that provision.

14.4 Assignment

You may not assign your rights under these Terms. First Pro may assign these Terms without restriction.

14.5 Force Majeure

Neither party is liable for delays or failures due to circumstances beyond their reasonable control.

By using First Pro: Fire Fighter Edition, you acknowledge that you have read, understood, and agree to these Terms of Service.
